An estate plan can range from a simple will and power of attorney to complex plans including trusts. An estate planning package from Williamson & Siler, S.C. can also include a Living Will, Transfer on Death Designation, Health Care Power of Attorney, Financial Power of Attorney and Marital Property Agreement when needed.

Wills

A will specifies to whom and how you want to distribute your estate and who you want to handle the distribution. A will can also name a guardian for your minor children or set up a trust to hold assets until they reach a later age while still providing for their welfare and education.

Powers of Attorney

A durable power of attorney allows you to appoint another person to handle your financial matters when you are unable to do so due to incapacity or incompetence due to an accident, illness or aging. These documents can also be very useful in avoiding guardianship.

A health care power of attorney allows you to appoint someone to make medical decisions for you when you are unable to make those decisions yourself. They also let you specify what kind of treatment you desire if you are unable to communicate your wishes.

Trusts

A revocable living trust is primarily used to avoid probate by transferring assets into the trust during your lifetime and providing for the transfer of those assets upon death. A trust can also allow you to minimize taxes, give to charity and provide for a special needs child.
